Terms of Service
1. Acceptance and Eligibility
These Terms of Service ("Terms") govern access to and use of the Skindex mobile application, websites, and related services (collectively, the "Services"). "Skindex," "we," "us," and "our" mean the operator of the Skindex app. By downloading, installing, accessing, or using the Services, you agree to be bound by these Terms and our Privacy Policy, incorporated herein by reference. If you do not agree, do not use the Services.
You may use the Services only if you are able to form a binding contract and are not barred from doing so under applicable law. You must be at least 18 years of age to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
The Services include different roles — including professional users such as licensed estheticians or skincare professionals ("Professionals") and regular or client users ("Clients"). Features, permissions, and obligations may differ by role.
- Professionals: By registering as a Professional, you represent and warrant that you hold a valid, active esthetics or cosmetology license in the jurisdiction(s) in which you practice, and that you will remain in good standing and comply with all applicable licensing requirements throughout your use of the Services.
- Clients: By registering as a Client, you represent that you are at least 18 years of age and are accessing the Services to receive care-related communications from your connected Professional.
2. Professional Responsibility
Important — Not Medical Advice
Skindex is a software tool designed to support the administrative and communication workflow of licensed esthetic professionals. It is not a medical device, healthcare platform, or clinical records system. Nothing in the Services constitutes medical advice, medical diagnosis, or medical treatment of any kind. If you believe you are experiencing a medical emergency, call 911 or your local emergency number immediately. Do not rely on the Services for urgent health matters.
Skindex supports professional skincare workflows and decision-support. Professionals remain solely responsible for:
- Using independent professional judgment in all client interactions.
- Confirming that use of the Services is within their license, certification, scope of practice, and applicable law.
- Reviewing, editing, accepting, rejecting, or ignoring any AI-assisted output before acting on it.
- Obtaining any client consents required by law, professional rules, or applicable regulations — including consents for AI-assisted or decision-support features involving client data.
- Maintaining required records, disclosures, and client communications.
- Complying with applicable privacy, consumer protection, and professional conduct regulations.
- Face Map disclosure: Before first using Face Map with a Client, and before any material change in its purpose, captured data, or sharing, explain whether Face Map will be used, its purpose, what may be captured, how it may be stored or shared, that participation is optional, and how the Client may decline or withdraw.
- Face Map consent and documentation: Obtain and document any professional or legally required consent, and confirm the Client's separate Skindex Face Map opt-in is active before capturing or uploading Face Map photos or related observational signals.
- Face Map communications and sharing: Remain responsible for client communications and for deciding what Face Map records to share through the Services. Skindex's platform opt-in does not replace the Professional's own disclosure or consent process.
- Face Map limits and review: Do not represent Face Map as diagnosis, treatment, identity recognition, surveillance, emergency guidance, or a guarantee of results. Independently review all Face Map outputs before applying them in a professional context.
Clients should not rely on the Services as a substitute for medical advice. For medical concerns, emergency symptoms, infection, allergic reaction, severe irritation, or suspected disease, contact a qualified medical professional.
3. Decision-Support and AI-Assisted Features
Decision-Support Tools — Professional Responsibility
Professionals are solely responsible for independently evaluating all AI Assist outputs, Skin Snapshot results, and Face Map analysis before applying them in any professional context. These tools are decision-support aids — they do not replace professional judgment, scope-of-practice obligations, or informed consent requirements.
The Services may include AI Assist, Skin Snapshot, Face Map, and similar decision-support features. The following terms apply:
- Outputs are not medical advice. Decision-support outputs are generated from structured data in your account and are intended to inform professional decision-making only. They are not diagnoses, clinical recommendations, or determinations of medical necessity.
- Outputs may be incomplete or incorrect. AI-generated suggestions are based on available data at the time of the request and may be incomplete, outdated, inapplicable, or factually incorrect. Evaluate them critically.
- Professional review is required. No decision-support output is applied to a client record automatically. All outputs require deliberate Professional action. There are no fully automated decisions affecting client records.
- Face Map consent, storage, and boundaries. Face Map is optional and Provider-initiated. A Client's separate Skindex Face Map opt-in is required before capture or processing; general Client Data Sharing Consent or acceptance of these Terms does not authorize it. When enabled, Face Map photos and related records may be stored in private, relationship-scoped Skindex infrastructure to support the workflow. In the current production flow, Face Map photos are not sent to OpenAI, RevenueCat, Sentry, advertising systems, or identity-recognition services.
- Safety controls. Skindex may apply safety filters, policy gates, rate limits, feature flags, and other controls to reduce risk and protect the Services.
- No guarantee of availability. AI Assist and other decision-support features may be modified, limited, or discontinued without notice.
4. Service-Improvement Data
To operate, secure, audit, and improve the Services, Skindex may collect and process limited account-scoped interaction, workflow, and outcome data from both Professionals and Clients when they use or are connected to decision-support features. Examples may include:
- Feature actions such as viewed, accepted, edited, dismissed, ignored, saved, or exported suggestions.
- Query categories, feedback signals, progress or visit outcome indicators, timestamps, and workflow state.
- Safety events, policy-gate outcomes, rate-limit events, abuse-prevention signals, and error states.
- Model, prompt, policy, ruleset, ranking, and app version metadata.
- Privacy-preserving technical request fingerprints used for deduplication, security, auditability, and collision prevention.
Skindex may use this data to evaluate output quality, detect unsafe or low-quality behavior, improve retrieval and ranking, adjust prompts and playbooks, measure workflow friction, and test feature changes.
Skindex does not use this data for facial identity recognition, biometric surveillance, cross-context behavioral advertising, or sale of personal information for money. Skindex does not knowingly use raw client photos, free-text notes, or protected health information to train public foundation models unless expressly disclosed, contractually permitted, and legally authorized.
5. Privacy
Use of the Services is also governed by the Skindex Privacy Policy, which is incorporated into these Terms by reference.
6. Acceptable Use and Prohibited Conduct
You agree not to:
- Use the Services for unlawful, harmful, deceptive, abusive, or discriminatory purposes.
- Attempt to identify a person from Face Map outputs, technical metadata, or de-identified or aggregated data.
- Upload, transmit, or distribute content you do not have the right to upload.
- Impersonate any person or entity, or misrepresent your affiliation, credentials, or role.
- Circumvent rate limits, policy gates, subscription controls, security controls, or access controls.
- Reverse engineer, decompile, disassemble, scrape, overload, probe, or interfere with the Services.
- Use automated means (bots, scrapers, crawlers) to access, collect, or extract data from the Services without our written authorization.
- Transmit malicious code, viruses, or any disruptive software or data.
- Use decision-support outputs as the sole or primary basis for a professional recommendation without independent evaluation.
- Use decision-support outputs as medical diagnosis, emergency guidance, or a substitute for required professional judgment.
- Exploit the Services for commercial resale, sublicensing, or any unauthorized commercial purpose.
We may suspend or terminate access if we believe an account creates legal, security, safety, fraud, abuse, or operational risk.
7. User Content and Permissions
Your content: You retain ownership of all client records, treatment notes, images, messages, and other content you create or upload within the Services ("User Content"). By using the Services, you grant Skindex a limited, non-exclusive, royalty-free license to host, process, transmit, display, and use that content as needed to provide, secure, support, audit, and improve the Services — subject to the Privacy Policy, applicable agreements, and law.
Professionals represent that they have authority to upload or process client information through the Services and that they will provide required notices and obtain required consents.
Our intellectual property: All Skindex branding, trademarks, logos, UI design, software code, and original platform content are the exclusive property of Skindex and are protected by applicable intellectual property laws. You may not reproduce, modify, distribute, or create derivative works from our intellectual property without our prior written consent.
8. Subscriptions and Payments
- Paid subscriptions are available for Professionals and are billed through Apple's in-app purchase system. By subscribing, you agree to Apple's applicable terms.
- Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before renewal. The renewal charge is applied to your Apple ID account.
- To cancel: open iPhone Settings → tap your name → Subscriptions → Skindex → Cancel Subscription. Cancellation takes effect at the end of your current paid period.
- We do not process refunds directly. Refund requests are handled by Apple per Apple's refund policy. Visit reportaproblem.apple.com to submit a refund request.
- Downgrading from a paid plan removes access to premium features but does not delete your data.
- Account deletion does not automatically cancel an active subscription. Cancel your subscription separately to stop future charges.
9. Availability and Changes
We may modify, suspend, discontinue, or limit the Services, including beta, AI-assisted, decision-support, or self-improvement features, at any time. We may also update models, prompts, playbooks, ranking rules, safety policies, rate limits, and feature flags. Where reasonably practicable, we will provide advance notice of material changes.
10. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SKINDEX EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR FITNESS FOR PROFESSIONAL USE OF ANY DECISION-SUPPORT OUTPUT, AI ASSIST SUGGESTION, SKIN SNAPSHOT RESULT, OR FACE MAP ANALYSIS GENERATED BY THE SERVICES.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SKINDEX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, LOST DATA, BUSINESS INTERRUPTION, PROFESSIONAL DISCIPLINE, CLIENT DISPUTES, OR RELIANCE ON DECISION-SUPPORT OUTPUTS — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITIES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
12. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Skindex and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: your User Content; your professional services; your violation of these Terms; your misuse of the Services; your violation of any applicable law; or your reliance on AI-assisted outputs without appropriate independent professional review.
13. Suspension and Termination
- We may suspend or terminate your access to the Services at our discretion if we determine that you have violated these Terms, violated applicable law, or engaged in conduct harmful to other users or to the Services.
- Where reasonably practicable, we will provide advance notice of suspension or termination, unless immediate action is necessary to protect users or the integrity of the Services.
- You may terminate your account at any time by visiting skindex.app/account-deletion or by contacting support.
- Upon termination for any reason, your right to access the Services ceases immediately. Sections of these Terms that by their nature should survive termination will remain in effect.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Services shall be resolved in the applicable courts, and you hereby consent to the personal jurisdiction of such courts.
Notwithstanding the foregoing, we reserve the right to seek injunctive or other equitable relief in any jurisdiction to protect our intellectual property or the integrity of the Services.
15. Changes to These Terms
We may update these Terms from time to time. We will post the updated version at skindex.app/legal/terms and update the "Last updated" date. Material changes may receive additional notice via in-app notification or email where required. Your continued use of the Services after the effective date of changes constitutes your acceptance of the revised Terms.
